Cattaraugus County Public Defender's view from parking lotIn compliance with federal and state constitutions, the Cattaraugus County Public Defender's Office is a legal service component of Cattaraugus County Government which:

  • provides quality legal representation to its clients;
  • advocates for the protection of the constitutional rights of its clients;
  • contributes to the efficient and effective operation of the criminal justice system in Cattaraugus County;
  • where appropriate, advocates and works toward achieving results that have the greatest likelihood to help rehabilitate clients; and,

In Cattaraugus County, eligibility for appointed counsel is based on the federal poverty guidelines. Income, family financial responsibilities, property interest and the nature of the charges are all considered in determining an applicant's qualification for free legal representation. You will have to disclose your income and your assets. A public defender will be appointed if it is determined that you do not have the ability to retain your own lawyer and you are charged with a felony or a misdemeanor. Further the Cattaraugus County Public Defender provides representation to individuals involved in custody, visitation, abuse/neglect and support violation matters in Family Court.

Presently, the Cattaraugus Public Defender's office is staffed with five full-time attorneys, one full-time investigator, a full time Secretary to the Public Defender, a full-time Confidential Law Clerk and a full-time Receptionist.

The Cattaraugus County Public Defender's office is open Monday through Friday

from 8:00 am until 5:00 pm. If applying in person, applicants must bring verification of income or support. If applying by mail, applicants must likewise include income verification.
